Looktara — Terms of Service
Effective date: August 17, 2025
These Terms of Service (“Terms”) are a legally binding agreement between MarkupX Brands Technologies
Private Limited (“Looktara”, “we”, “us”, “our”) and the individual or entity who accesses or uses our Services
(“you”, “your”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do
not use the Services.

1) Definitions
● Services: The Looktara website and app, the Looktara Chrome Extension, our APIs, model-training and
image-generation features (including “prompt → photo” and “reference + prompt → image”), WhatsApp daily
prompts/images, smart galleries, and any related software, documentation, and support.
● Content: Anything submitted or generated through the Services, including your photos, prompts, reference
images, model artifacts, and outputs (generated images).
● User-Scoped Model Artifacts: Model weights/embeddings (e.g., LoRA) created from your training photos to
reproduce your likeness for your use.
● Subscription: A paid plan that provides access to credits/features for a period (e.g., monthly/annual),
renewing unless cancelled.
2) Eligibility & Account
● Age: You must be 18+ and capable of forming a binding contract. The Services are not for children under 13.
● Account Security: Keep your credentials confidential; you are responsible for all activity under your account.
Notify us immediately of unauthorised use.
● Accurate Info: Provide true, complete, and current information; keep it updated.
3) What the Services Do (High Level)
● Train a user-scoped likeness model from your photos (opt-in by uploading) and generate images per your
prompts or reference + prompt.
● The Chrome Extension lets you draft on supported sites (e.g., LinkedIn/X) and, when you trigger it, prefill
from your editor text and insert selected outputs. The extension does not collect your general browsing
history.
● WhatsApp daily prompts/images (if you opt in) and a gallery to view/manage outputs.
4) Acceptable Use & Prohibited Conduct
You must comply with all laws and these rules. You may not:
1. Rights & Safety
○ Upload or generate illegal content, CSAM, exploitation of minors, or content that is hateful, harassing,
or incites violence.
○ Impersonate a person without their explicit, written consent; create deceptive “deepfakes”; violate
privacy or publicity rights.
○ Infringe IP rights (copyrights, trademarks, design rights) or breach confidentiality or contracts.
2. Security & Integrity
○ Attempt to gain unauthorised access, probe, scan, or test vulnerabilities; interfere with or disrupt the
Services.
○ Upload malware or perform denial-of-service attacks.
3. Model/Platform Misuse
○ Scrape, spider, or bulk-extract data except via permitted APIs.
○ Reverse engineer, decompile, or attempt to extract source code or model weights (except where
allowed by applicable law).
○ Circumvent usage limits, credit systems, or paywalls; create multiple free accounts to evade limits.
4. Sensitive/Regulated Use
○ Use outputs to mislead in elections or political persuasion, defraud, commit scams, or create forged
IDs/credentials.
○ Use any portrait of a minor (under 18) for training, prompts, reference, or outputs.
We may remove content, limit features, suspend, or terminate accounts that violate these Terms.
5) Your Content; Ownership & Permissions
5.1 You Own Your Inputs and (Subject to Law) Your Outputs
● You retain ownership of photos, prompts, and other materials you submit, and—subject to third-party
rights and applicable law—you own the outputs generated for you.
● Outputs are not guaranteed unique; similar prompts by others may yield similar results.
5.2 Your Responsibilities & Representations
You represent and warrant that:
● You either own the rights in your uploads or have all necessary permissions/consents (including from any
identifiable person).
● Your use of the Services and any outputs will comply with laws and these Terms.
● If you upload anyone else’s likeness, you have their express written consent and confirm they are 18+.
5.3 Licence You Grant to Looktara (Service Operation)
You grant Looktara a worldwide, non-exclusive, royalty-free licence to host, store, process, reproduce, transmit,
display, adapt, and create derivative works from your Content and User-Scoped Model Artifacts solely to:
(i) provide and maintain the Services;
(ii) operate security/abuse detection;
(iii) troubleshoot, support, and ensure reliability; and
(iv) comply with law.
We will not use your likeness training photos or User-Scoped Model Artifacts to train global/foundation
models without your explicit consent.
5.4 Publicity & Showcasing
We do not use your private uploads/outputs for marketing without your explicit permission. You can opt-in to share
examples.
6) Licences We Grant to You
● Service Licence: Subject to these Terms and payment of fees, we grant you a limited, personal,
non-exclusive, non-transferable, non-sublicensable licence to use the Services for lawful purposes.
● Outputs: Subject to your compliance with these Terms and third-party rights, you may use, publish, modify,
and commercialise your outputs.
7) Plans, Credits, Fees, Taxes, and Billing
● Pre-Paid: All fees are charged in advance and are due at purchase/renewal. Credits (if applicable) expire
per plan terms.
● Auto-Renewal: Subscriptions auto-renew until cancelled in your account before the next billing date.
● Price Changes: We may change prices; changes apply at your next renewal (we’ll notify you when required).
● Taxes: Fees are exclusive of taxes. You’re responsible for all applicable taxes and duties.
● Chargebacks: If you dispute a charge without basis, we may suspend the account until resolved.
● Team/Business Plans: The account owner is responsible for payment and use by authorised users.
7.1 Refunds
ALL FEES ARE NON-REFUNDABLE. NO REFUNDS, NO CREDITS. NOTHING.
To the maximum extent permitted by law, we do not provide refunds or credits for partial periods, unused credits,
dissatisfaction with outputs, or any other reason. Your statutory rights (if any) remain unaffected where
non-waivable by law.
8) Content Moderation; Takedowns
● We may review content for violations; we are not obligated to monitor all content.
● Copyright/Trademark complaints: Email team@looktara.com (subject: “Takedown Request”) with
sufficient detail (rights holder, work identified, location/URL or account, declaration of good-faith belief,
signature). We may remove content and, when appropriate, notify the user.
● We may report child exploitation or other illegal content to authorities.
9) Privacy
Your use of the Services is also governed by our Privacy Policy. It explains what we collect and how we use it
(including for the Chrome Extension and WhatsApp features). By using the Services, you consent to those practices.
10) Chrome Extension Specific Terms
● Operates only on declared hosts and only when you trigger actions.
● Uses activeTab, scripting, storage, and clipboardWrite (copy action) permissions.
● No collection of general browsing history; no remote code execution.
● Subject to the Chrome Web Store Developer Program Policies. You must install official builds only.
11) Third-Party Services & Links
● The Services may integrate with or link to third-party platforms (e.g., LinkedIn, X/Twitter, WhatsApp, payment
processors, cloud providers).
● We do not control third-party terms or privacy practices. Your use of them is at your discretion and subject to
their terms.
12) Service Changes; Beta Features
● We may add/remove features or suspend/stop the Services (in whole or part) with or without notice where
lawful.
● Beta/experimental features are provided “as is”, may be rate-limited, and may change or end at any time.
13) Suspension & Termination
We may suspend or terminate your access immediately if: (a) you breach these Terms or laws; (b) we suspect fraud,
abuse, or security issues; (c) required by law; or (d) non-payment.
You may stop using the Services and cancel at any time; no refunds will be issued.
Upon termination, licences end and we may delete or restrict access to Content per our retention practices (subject
to legal obligations).
14) Intellectual Property; Feedback
● We (and our licensors) own all right, title, and interest in the Services, software, models (excluding your
User-Scoped Model Artifacts), and Looktara trademarks.
● Feedback you provide may be used by us without restriction or compensation.
15) Disclaimers
THE SERVICES AND ALL OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
To the maximum extent permitted by law, we disclaim all warranties—express, implied, or statutory—including
merchantability, fitness for a particular purpose, non-infringement, and that outputs will be unique, accurate, or
error-free, or meet your expectations.
AI outputs may be similar to content produced for others and may require human review before use. You are
solely responsible for your use of outputs.
16) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
● WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL,
EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR
REPUTATION; OR COST OF SUBSTITUTE GOODS/SERVICES.
● OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES
SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO LOOKTARA IN THE 12
MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) INR 40,000 (or local currency
equivalent).
Some jurisdictions do not allow certain exclusions or limits; in those cases, the above applies to the fullest
extent permitted.
17) Indemnification
You will defend, indemnify, and hold harmless Looktara and its officers, directors, employees, and affiliates from
and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising
out of or related to: (a) your Content or outputs; (b) your use of the Services; (c) your breach of these Terms or law;
or (d) your violation of third-party rights.
18) Export Controls & Sanctions
You represent that you are not located in, under the control of, or a national/resident of any country or entity subject
to embargoes or sanctions. You will not use the Services in violation of export control or sanctions laws.
19) Governing Law & Venue
These Terms are governed by the laws of India, without regard to conflict-of-laws rules. You consent to the
exclusive jurisdiction and venue of the courts in New Delhi, India for all disputes arising out of or relating to
these Terms or the Services. Class or representative actions are waived to the extent permitted by law.
20) Changes to Terms
We may update these Terms from time to time. When required, we will provide notice (e.g., email or in-product).
Updates take effect on the stated effective date. Your continued use after changes means you accept the updated
Terms.
21) Miscellaneous
● Entire Agreement: These Terms and any referenced policies (including the Privacy Policy) form the entire
agreement between you and us.
● Severability: If any provision is unenforceable, the remainder stays in effect.
● No Waiver: A failure to enforce a provision is not a waiver.
● Assignment: You may not assign these Terms without our prior written consent. We may assign to an affiliate
or in connection with a merger, acquisition, or asset transfer.
● Force Majeure: We are not liable for delays or failures due to events beyond our reasonable control.
● Electronic Communications: You consent to receive notices electronically.
